Employment Tribunal success for our client

We are delighted to have supported our lovely client, Laura Jones (also known as Polly), with her Employment Tribunal claims against Hereford and Worcestershire Health and Care NHS Trust, Mr W Dolan, Mr D Thomas and Miss L Brennan.

Unsupportive workplace

Ms Jones succeeded with her claims against the NHS Trust for constructive unfair dismissal, wrongful dismissal and various types of disability discrimination.  Mr Dolan was also found personally liable for disability discrimination. Our client was awarded in excess of £50,000 in compensation which included £23,000 for injury to feelings.

Ms Jones was employed as a Physical Health Coordinator. She was diagnosed with complex PTSD following the tragic death of her young son. She asked for support from the NHS Trust who, sadly, failed to provide it to her. After exhausting the grievance process, she decided that she had no option but to resign and commence proceedings in the Employment Tribunal.

 

Justice and a positive outcome

When taking initial instructions from our client, we were alarmed to hear that Mr Dolan had told her that he did not like her emotive language, that everyone was moaning at him regarding her and that he was not interested. We were very pleased to hear that the Tribunal agreed and found such comments to be discriminatory.
